讲座一:

题目:U.S. Economic and Trade Sanctions: Impacts and Risks

Economic and trade sanctions are increasingly employed by the United States and Western allies to promote policy goals. Sanctions can be unilateral or multilateral and endeavor to either diminish access to the financial system and/or impose trade restrictions such as banning exports of technology or imports from a region. The 2022 sanctions against Russia for its military incursion into Ukraine which include the freezing of Russian sovereign assets and cutting off several Russian banks from SWIFT provide examples. U.S. sanctions are often based on the U.S. President’s empowerment to defend U.S. security via the IEEPA; and U.S. sanctions are also increasingly linked to alleged human rights problems overseas. China has responded with various legal mechanisms such as the AFSL and Blocking Statute. This lecture will provide deep knowledge about the various economic and trade sanctions which are increasingly being imposed as well as the mechanisms used to levy the sanctions. Economic and trade sanctions are likely to impact supply lines and trade alliances. Sanctions also carry the risk that longer-term, economic realism might prove sanctions not sustainable and/or will lead to the creation of China-centric and U.S.-centric trading blocs.

题目:Digital Currencies: China as a Global Leader in the Digital Age

The United States reign as global hegemon has been empowered by massive structural power over key international economic, technological and ideological networks. As chiefdisseminatorduring theeraof emerging computer technology and communications, the U.S. became a rules-maker, empowered to shape international governance in its favor.However, in the new era of data-driven digitalization, transactions and networks will provide an opportunity forCentral Bank Digital Currencies (‘CBDCs’) to constitutethe technological-financial-business bones of the developing digitalized global economy. CBDCs will exert massive influence on international economic, technological and ideological governance. Moreover, all of these impacts are inextricably connected to the hegemonic rivalry between the United States and China. Astutely, China has been developing the digital Yuan and is the first major economy to distribute a CBDC. If China’s CBDC successfully migrates to external usage, and depending upon the degree of crucial Chinese domestic reforms, the digital Yuan may offer an opportunity for China to be a disseminator in the digital age. Chinese influence over global networks and governance frameworks would vest China with advantageous structural power in the economic, technological and ideological spheres – the fulcrums of the U.S.-China strategic rivalry.

题目:The National Security Exception in Exceptional Times: The Exception and International Economic Law

The historical narrative of the national security exception in trade and investment has long been understood from the perspective of measures to defend the nation from military attack or territorial invasion. Indeed, the cornerstone of the existing global governance model encourages non-discriminatory trade and vigorous cross-border investment, thus the security exception in international economic agreements was envisioned as a “last-resort” allowing a nation to override international economic obligations only if necessary and invoked in good-faith to protect essential security. However, in a world of emergent technology, theorizing national security is more difficult and complex. Moreover, the two primary global powers are locked in a competitive struggle and the United States has in recent years aggressively resorted to national security to justify investment and trade policies against China. The foundational basis for doing so is a new conceptualization of national security constituting a fusion of interests encompassing the ideological, technological and economic. This re-conceptualization radically re-defines the understanding of national security far beyond the classic understanding of defending physical borders. Taken to its logical conclusion, the new conceptualization of security risks an unfettered broadening of the exception, driving a transformative re-alignment in the global international economic architecture.


讲座人简介:

Professor Joel Slawotsky is a former law clerk to the Hon. Charles H. Tenney, (U.S.D.J., S.D.N.Y.) and AV peer-review rated attorney at Sonnenschein (now Dentons). In practice, he represented large corporations litigating in federal and state courts at both the trial and appellate level. He has taught, lectured and presented at conferences in Asia, Europe, and both North and South America. Joel has published over 50 journal articles and book chapters.
